OUTRAGING MODESTY OF WOMAN SECTION-354

Modesty means feminine character present in a woman. Modesty of woman is considered to be from the birth of the woman child.
Amendment of section

1.Accused person should use criminal force against a woman or assault that woman.

2.He must use criminal force or assault with a guilty intention or knowledge.

3.That accused person should use that criminal force etc. With the intent to Outrage the Modesty of that woman.

4.The accused person must be knowing that by using criminal force or assault, he will thereby Outrage the Modesty of that Woman.

5.Then, the accused person is punishable with imprisionment for 2years or fine or both.

PRINCIPLES:-

1.Modesty is the essence of woman’s sexuality.

2.The modesty of an adult female is writ lagre on her body, she may be young or old, intelligent or imbecile, awake or sleeping.

A female child of seven and half months could be said t be possessing Modesty.

3.Modesty under Section 354 is an attribute associated with female human being.

4.Modesty is a virtue which attaches to a female owing to her sex.

5.A woman possess modesty from cradle to grave.

The accused played with the private parts of a Seven and half months girl baby and when the defendant’s parents caught him and filed a case against the accused. The accused  plea’s that a woman or girl child attains modesty at attaining the age of puberty.

The culpable intention of the accused is the trucks of the matter.

6.The action of pulling a woman or removing her sari coupled with a request to have sexual intercourse is Outraging her Modesty.

7.Patting the woman on her buttocks in public glare is considered to be outraging her modesty.

OR

POPULARLY KNOWN AS EVE TEASING:-

Whoever—

    1. Intending to insult the modesty of a woman;
    2. By uttering any word or gesture or making sounds or exhibiting any object;
    3. Intending that they be seen by that woman;
    4. Intrudes into the privacy of that woman;
    5. Is punishable with punishment for 1 year or 5 years or both.
